Escorted by three gendarmes from the community of brigades (COB) of Nègrepelisse, a 37-year-old truck driver, brought to the Montauban courthouse on Tuesday for new domestic violence committed on February 11 in Léojac, narrowly avoided to spend his first night in prison.
Tried in immediate appearance in the process, the 30-year-old, who has a criminal record studded with 12 mentions mainly for traffic offences, requested, on the advice of his lawyer, a dismissal for prepare his defence, as provided for in the code of criminal procedure.
The court then only has to examine whether it decides, pending trial, to place the defendant in pre-trial detention. The latter, unemployed and having a common residence with the victim, the substitute Emmanuel Ferrand unsurprisingly requests the warrant of deposit. " He has already been sentenced for these same facts last February in Châlons-en-Champagne, the risk of repetition is high and his guarantees of representation are weak ", specifies the magistrate of the public prosecutor's office.
The battered woman pleads for her husband
Requisitions which are however thwarted by the testimony of the victim who came to speak at the bar of the court. “ My husband needs care, hospitalization, she claims. He is a non-violent person. I have nothing to reproach him ”, she continues in front of President Emmanuel Abentin and his two judges – dumbfounded assessors.
A few minutes earlier, the President had briefly recalled the facts, and the 3 days of ITT (incapacity total work) awarded to the victim by the medical examiner. " You grabbed her by the hair and threw her on the sofa, threatened with death... During the findings, there were redness, bruises and pain on her nose ". The lawyer of the violent husband does not fail to recall, for his part, that his client made a suicide attempt in his cell while in police custody. " He worked at night and took care of the children during the day : he was exhausted ", justifies Me Diane Payrou, asking the court to avoid detention.
After deliberating, the president follows her by placing the driver under judicial control with the obligation of care, and monitoring by agents of AVIR 82 (association for assistance to victims and reintegration). Psychiatric expertise is also required. The trial is adjourned to May 20.
