Lyon: Three young Algerians tried for having killed a compatriot in 2019 in France, were sentenced to sentences of 13 to 20 years' imprisonment on Friday for murder and aggravated violence, by an assize court of minors.
The body of Ahmed Kourak, a 28-year-old fisherman, had been discovered feet and fists linked, mutilated with sixty stab wounds, in early March 2019 in an apartment in Lyon (center-east of France).
The scene had been filmed and broadcast on social networks.
The pronounced penalties, lower than the requisitions, disappointed the civil party, for whom this trial "took place for nothing".
According to lawyer for the victim's family, he did not shed light on the crime mobile, while a mobile phone flight was mentioned during the investigation.
The hearing was held this week in Lyon at home due to the minority of one of the accused at the time of the facts.
The three young men, who appeared with an open face on the video, appeared for "murder in an organized gang" and "torture or act of barbarism in an organized gang".
But according to the civil party, the latter chief was dismissed by the Advocate General who deemed difficult to distinguish injuries under torture and those who led to the death of the victim.The court followed it.
The Advocate General had requested Thursday 30 years' imprisonment for the three men.Two of them, aged 18 at the time of the events, were sentenced to the end to 20 years.For the third, 17 years old in 2019 and considered to have brought the most blows to the victim, the minority excuse was retained: he was sentenced to 13 years of imprisonment.
"We would have liked the perpetuity given the acts he has committed, of a inhuman atrocity," said Jean-Baudouin Shibaba, lawyer for the Kourak family, who also expressed his "great disappointment" because"The abandonment of acts of torture and barbarism".
Me Laëtitia Birenbaum, one of the minor's lawyers, praised on the contrary "a just and adapted sentence in this file".
Defense does not intend to appeal and the general prosecutor's office either, according to the civil party.
A fourth man, aged 15 at the time, suspected of being the author of the video, had been delivered to the police in October 2019 by a second victim who managed to escape.He will be tried later by the children's court.
